Service Description

VidMachine is an AI-powered video generation and YouTube automation platform that allows users to create high-quality videos using advanced AI models (including Google VEO, OpenAI Sora, and others) and automatically upload and manage content on YouTube channels. The service generates video content, creates narrations using AI voice synthesis, and can automatically post videos to connected YouTube channels based on your project configurations.

CRITICAL: YouTube Account Disclaimer - Your Responsibilities

YOU ARE SOLELY AND FULLY RESPONSIBLE FOR YOUR YOUTUBE CHANNEL AND ALL CONTENT POSTED. VidMachine is not responsible for any account bans, suspensions, terminations, monetary losses, or any other consequences resulting from your use of this service with YouTube.
By using VidMachine to upload content to YouTube, you acknowledge and agree that:
  • Account Bans and Suspensions: We are NOT responsible for any YouTube account bans, suspensions, terminations, or restrictions that may occur as a result of using our service. YouTube reserves the right to take action against accounts that violate their Terms of Service, Community Guidelines, or any other policies.
  • Monetary Losses: We are NOT responsible for any monetary losses, including but not limited to lost ad revenue, lost sponsorships, lost channel monetization, or any other financial damages resulting from YouTube account actions, content removal, or channel restrictions.
  • Content Responsibility: You are solely responsible for all content generated and posted through VidMachine. You must ensure all content complies with YouTube's Terms of Service, Community Guidelines, copyright policies, and all applicable laws.
  • YouTube Policies: You are responsible for understanding and complying with all YouTube policies, including but not limited to: Terms of Service, Community Guidelines, Copyright policies, Monetization policies, and any other rules or restrictions that may apply to your channel.
  • Automated Uploads: Using automated tools to upload content may violate YouTube's Terms of Service. You acknowledge that YouTube may take action against accounts using automation, and you accept full responsibility for any consequences.
  • Content Quality and Compliance: You are responsible for reviewing all generated content before it is posted to ensure it meets your standards and complies with all applicable policies and laws. VidMachine provides tools but does not guarantee content quality or compliance.
VidMachine provides video generation and automation tools but does NOT provide legal advice or guarantee compliance with YouTube policies. We are NOT responsible for your compliance with YouTube's Terms of Service or any other platform policies. Violations can result in account termination, loss of monetization, legal action, and other severe consequences. You use this service entirely at your own risk and accept full responsibility for all content posted and all consequences that may result.

User Responsibilities

By using VidMachine, you agree to:
  • Comply with all applicable laws, including copyright, intellectual property, and content regulations
  • Comply with YouTube's Terms of Service, Community Guidelines, and all other platform policies
  • Ensure all generated content is original, properly licensed, or used with appropriate permissions
  • Review all content before it is posted to ensure accuracy, quality, and compliance
  • Maintain the security of your account credentials and connected services (YouTube, etc.)
  • Not use the service to create or post content that is illegal, harmful, defamatory, or violates any rights
  • Not use the service to infringe on copyrights, trademarks, or other intellectual property rights
  • Accept full legal responsibility for all content generated and posted through your account
  • Indemnify and hold harmless VidMachine from any claims, damages, legal action, or losses resulting from your use of the service
  • Not hold VidMachine responsible for any YouTube account actions, bans, suspensions, or monetary losses

Account Termination and Service Limitations

We reserve the right to refuse service, suspend, or terminate any user account at our sole discretion, with or without notice, for any reason we deem appropriate, including but not limited to:
  • Violation of these Terms of Service
  • Violation of YouTube's Terms of Service or Community Guidelines
  • Creating or posting content that is illegal, harmful, or violates any rights
  • Infringement of copyrights, trademarks, or other intellectual property rights
  • Abuse of the service or use in ways that harm our reputation or operations
  • Fraudulent activity, payment disputes, or chargebacks
  • Excessive use of resources or attempts to overload our systems
  • Any behavior we determine to be inappropriate, harmful, or in violation of our policies
Account Termination Consequences:
  • Upon account termination, your access to the service will be immediately revoked
  • We are not obligated to provide refunds for terminated accounts
  • We may delete or retain your data at our discretion
  • Terminated accounts may not be eligible for future service
  • You remain responsible for all actions taken through your account prior to termination

Payment Terms

Subscription fees are billed monthly in advance. By subscribing, you authorize us to charge your payment method for the subscription fee. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.

Limitation of Liability

To the maximum extent permitted by law, VidMachine and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.
Specifically, but without limitation, VidMachine shall not be liable for:
  • Any YouTube account bans, suspensions, terminations, or restrictions
  • Any monetary losses, including lost ad revenue, lost sponsorships, or lost monetization
  • Any content removal, demonetization, or channel restrictions by YouTube or other platforms
  • Any copyright claims, strikes, or legal actions related to generated or posted content
  • Any errors, bugs, or failures in AI-generated content
  • Any service interruptions, downtime, or technical issues
  • Any data loss or corruption
  • Any third-party service failures or disruptions

Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice. We may also update these Terms of Service from time to time, and continued use of the service constitutes acceptance of any changes.

Content and Intellectual Property

You retain ownership of content you create using VidMachine, subject to the following:
  • You are solely responsible for ensuring you have the right to use any content, including images, music, or other materials incorporated into your videos
  • You grant VidMachine a license to use, store, and process your content solely for the purpose of providing the service
  • You represent and warrant that your content does not infringe on any third-party rights
  • You are responsible for all copyright, trademark, and intellectual property compliance
  • VidMachine is not responsible for any copyright claims, strikes, or legal actions related to your content
AI-generated content may be subject to the terms and conditions of the AI service providers we use. You are responsible for understanding and complying with those terms as well.

Indemnification

You agree to indemnify, defend, and hold harmless VidMachine, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of the service; (ii) your violation of these Terms of Service; (iii) your violation of any third-party rights, including but not limited to YouTube's Terms of Service; (iv) any content you create, post, or distribute through the service; (v) any claims that your content infringes on any third-party rights; and (vi) any other claims related to your use of the service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
VidMachine does not warrant that the service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee the accuracy, quality, or suitability of AI-generated content. You acknowledge that AI-generated content may contain errors, inaccuracies, or may not meet your expectations.
